Terms of Use
These terms explain the rules, responsibilities, risks, and limits that apply when you use Bayaban.
1. About these Terms
These Terms of Use govern your access to and use of Bayaban, including the Bayaban mobile application, website, account services, club features, drive features, maps, location features, notifications, reports, and related services (together, the “Service”).
Bayaban is owned and operated by Khalil Rehman, an individual based in Islamabad Capital Territory, Pakistan. In these Terms, “Bayaban”, “we”, “us”, and “our” mean Khalil Rehman. “You” means the person using the Service.
By creating an account, continuing to use the Service, or accepting these Terms in the app, you agree to be bound by them. If you do not agree, do not create an account or use the Service.
2. Eligibility
You must be at least 18 years old to use Bayaban. By using the Service, you confirm that you meet this requirement and can legally enter into these Terms.
The Service is offered worldwide. You are responsible for ensuring that your use of it is lawful where you live, travel, or participate in a drive.
3. The Service
Bayaban helps off-road users organise clubs and drives, communicate with authorised participants, record routes, view drive information, and keep reports of completed activities.
Bayaban is a coordination and record-keeping tool. It is not a transport service, guide service, rescue service, emergency service, navigation guarantee, medical service, insurance product, or substitute for local knowledge and personal judgement.
Features may change, be suspended, or be discontinued. We do not promise that every feature will always be available, accurate, uninterrupted, or suitable for every location or device.
4. Accounts and sign-in
You must provide information that is accurate and keep it up to date. You are responsible for protecting your password, email account, verification codes, and device. Do not share them or allow another person to use your account.
You must tell us promptly if you believe your account has been accessed without permission. We may ask you to verify your identity before making account or data changes.
You may have only one personal account unless we expressly allow otherwise. You must not impersonate another person, create an account for someone else without permission, or use a temporary or misleading identity to avoid enforcement.
5. Clubs and club management
Users may create, join, manage, or leave clubs. Club information, membership, invitations, join requests, roles, and visibility are controlled by the Service and the applicable club settings and rules.
Club founders, co-founders, owners, and admins may manage club information, member records, join requests, and club drives within the permissions provided by the Service. Bayaban may also have platform-level administrators for support, moderation, security, and safety functions.
Senior Marshals and Marshals may receive limited drive-creation, attendance, participant, or live-drive responsibilities where the Service assigns those permissions. A role does not give a user unlimited access to all club or account information.
Club organisers are responsible for the club rules they publish and for using the available permissions lawfully and fairly. Bayaban does not guarantee the conduct, identity, experience, qualifications, or reliability of any club member or organiser.
6. Drives and participation
A personal drive may be created by its owner. A club drive may be created by an authorised club role or other user permitted by the Service. Some club drives may require approval before they are published or opened for participation.
Drive organisers may set meeting information, difficulty, participant limits, drive type, attendance rules, roles, invitations, and additional terms. Participants must read and follow those requirements before joining or attending.
Joining a drive does not guarantee that it will take place. Drives may be changed, delayed, cancelled, aborted, or ended early because of weather, terrain, safety, permissions, vehicle issues, participant conduct, technical problems, or other circumstances.
You are responsible for deciding whether you, your passengers, and your vehicle are prepared for a drive. You must follow applicable laws, site rules, landowner requirements, convoy instructions, and reasonable safety directions.
7. Off-road and wilderness risks
Off-road driving and wilderness activity can involve serious risks, including collision, rollover, mechanical failure, vehicle recovery, injury, illness, drowning, fire, wildlife, falling objects, extreme weather, poor visibility, unstable terrain, remote locations, loss of communications, and delayed emergency response.
You participate at your own risk. You must make your own safety assessment, carry appropriate equipment, maintain your vehicle, plan for fuel and communications, and avoid relying on Bayaban as your only source of navigation, route information, or assistance.
A route, map, elevation, distance, GPS position, meeting point, or drive report may be incomplete, delayed, inaccurate, unavailable, or affected by device, satellite, weather, terrain, battery, network, or user error. Always verify conditions independently.
8. Location, maps, and background recording
If you grant permission, Bayaban may use your device location while an active drive is being recorded, including in the background where the operating system and your settings allow it. You can control permissions through your device settings, but turning them off may prevent recording or safety features from working.
Maps and map information are supplied through third-party mapping services. Bayaban does not control their accuracy, availability, road information, satellite coverage, routing, or terms. Do not treat the map as proof that a road or route is safe, legal, open, or passable.
You must not use Bayaban while driving in a way that distracts you or violates the law. Stop safely before interacting with the app.
9. Emergency and safety features
Safety, emergency, GPS interruption, marshal, and incident features are communication aids only. They do not automatically contact emergency services, guarantee that anyone will see an alert, or guarantee a response, rescue, recovery, or medical assistance.
In an emergency, contact local emergency services directly and use any other available method of assistance. Do not wait for Bayaban or another user to respond.
10. Offline use and synchronisation
Some information may be stored temporarily on your device so the Service can work with limited connectivity. The app may upload or reconcile that information later. A device may lose power, be damaged, reset, or fail to upload information.
You are responsible for keeping your device charged and protecting it from loss or unauthorised access. Bayaban does not guarantee that an offline record, route, message, notification, or report will be preserved or synchronised successfully.
11. Your content and conduct
“User Content” means information, text, images, profile details, route data, comments, club material, drive information, incident notes, and other material you submit, record, upload, or make available through the Service.
You retain any rights you have in your User Content. You give Bayaban a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, display, transmit, and format your User Content only as needed to operate, secure, provide, and maintain the Service and to show it to the people you authorise through the Service.
Bayaban currently does not use User Content for advertising, sale, AI model training, unrelated analytics, or unrelated product-improvement purposes. If that changes, we will update the Privacy Policy and obtain consent or provide choices where required by law before using data for a materially different purpose.
You must not submit anything you do not have the right to share. You must not use the Service to harass, threaten, stalk, defame, exploit, impersonate, discriminate against, expose private information about, or endanger another person.
You must not upload malware, interfere with the Service, bypass access controls, scrape or bulk-export data, reverse engineer the Service except where the law expressly permits it, or use the Service for unlawful surveillance, spam, fraud, or commercial exploitation without our written permission.
12. Visibility and sharing
Information may be visible to other users according to your profile settings, club membership, drive participation, invitations, assigned roles, drive rules, and the permissions built into the Service. Anything you intentionally share with a club or drive may be copied, remembered, or used by recipients outside Bayaban.
Do not share another person’s personal information, precise location, image, vehicle information, or emergency information unless you have a lawful basis and permission to do so.
Bayaban cannot control what authorised recipients do with information after they can lawfully view it. Use privacy settings carefully and share only what is necessary.
13. Intellectual property
The Service, including its software, design, branding, text, graphics, logos, interfaces, and documentation, belongs to Bayaban or its licensors and is protected by applicable intellectual-property laws.
Subject to these Terms, we give you a limited, personal, non-transferable, non-exclusive, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, sell, licence, or create derivative works from Bayaban or its branding.
14. Third-party services
The Service may depend on third-party services such as hosting, authentication, maps, email delivery, push notifications, device operating systems, app stores, storage, and network providers. Those services may have their own terms, privacy policies, outages, limitations, and fees.
We are not responsible for third-party services, including their availability, accuracy, security, content, decisions, or handling of information. Your use of them may be subject to their terms.
15. Availability and changes
We may update, restrict, suspend, or discontinue all or part of the Service at any time. We may do so for maintenance, security, legal compliance, abuse prevention, safety, technical limitations, or business reasons.
We may update these Terms. The latest version will be posted on this page and may be shown in the app. If a change materially affects your rights or obligations, we will provide notice or request renewed acceptance where required by law. Continued use after the effective date means you accept the updated Terms, except where renewed acceptance is required.
16. Fees and future features
Bayaban is currently free to use. We may introduce paid features, subscriptions, or other charges in the future. We will show the price and applicable conditions before charging you. A future paid track-download or track-reuse feature does not exist unless and until it is clearly made available in the Service.
17. Suspension and termination
You may stop using the Service at any time and may delete your account through the available account controls. We may suspend or terminate access if you breach these Terms, create risk, misuse the Service, fail to meet eligibility requirements, or if action is reasonably needed for security, safety, legal, or operational reasons.
Termination may remove access to your account, clubs, drives, reports, and User Content. Provisions that by their nature should continue, including ownership, disclaimers, liability limits, indemnity, dispute terms, and privacy-related obligations, will continue as permitted by law.
18. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties or guarantees of any kind, whether express, implied, statutory, or otherwise. We disclaim warranties of accuracy, availability, fitness for a particular purpose, merchantability, non-infringement, reliability, security, uninterrupted operation, and suitability for a particular route, vehicle, person, club, or activity.
Nothing in Bayaban is professional, safety, medical, legal, insurance, rescue, or navigation advice. You remain responsible for your decisions, conduct, vehicle, passengers, equipment, route, and participation.
19. Limitation of liability
To the maximum extent permitted by applicable law, Khalil Rehman and Bayaban will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss; loss of data, access, income, profits, business, goodwill, opportunity, or anticipated savings; vehicle damage; personal injury; death; delay; failed communication; failed synchronisation; inaccurate location or route information; or any loss arising from participation in a club, drive, outdoor activity, or use of the Service.
To the maximum extent permitted by applicable law, our total liability for claims arising out of or relating to the Service or these Terms will not exceed the amount you paid to use the Service during the twelve months before the event giving rise to the claim. Because the Service is currently free, this amount is currently zero, except to the extent a liability cannot lawfully be limited or excluded.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud or any other liability that applicable law requires us to retain.
20. Indemnity
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Khalil Rehman and Bayaban from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or related to your User Content, your breach of these Terms, your unlawful or unsafe conduct, your misuse of the Service, your violation of another person’s rights, or your participation in any club, drive, or outdoor activity.
We may take control of the defence of a claim covered by this section. You must reasonably cooperate with us. You may not settle a claim in a way that admits fault or imposes obligations on us without our written consent.
21. Governing law and courts
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Subject to any mandatory rights you have in your country of residence, the courts located in Islamabad Capital Territory, Pakistan will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service.
Nothing in this section prevents you from using a mandatory consumer, privacy, or other legal right that cannot lawfully be waived in your country.
22. General terms
If any provision is found unenforceable, it will be narrowed or removed only to the extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations as part of a reorganisation, sale, merger, or transfer of the Service.
These Terms and the Privacy Policy are the agreement between you and Bayaban about the Service and replace earlier statements about the same subject. Additional club or drive rules apply to the relevant activity and do not override these Terms unless we expressly agree in writing.

Privacy Policy
This policy explains what information Bayaban handles, why it is needed, who may receive it, and how you can make privacy or deletion requests.
1. Who we are
This Privacy Policy explains how Bayaban handles information when you use the Bayaban mobile application, website, account services, club features, drive features, maps, location features, notifications, reports, and related services (together, the “Service”).
Bayaban is owned and operated by Khalil Rehman, an individual based in Islamabad Capital Territory, Pakistan. For privacy questions or requests, contact bayabanapp@gmail.com. Bayaban is intended for users worldwide.
2. What this policy covers
This policy applies to information collected through the Service, information you provide to us, information generated when you use the Service, and information received from other users or service providers in connection with the Service.
The Service may link to third-party websites or services. Their own privacy policies apply to their handling of information.
3. Account and sign-in information
Bayaban currently supports email/password sign-in and email OTP verification or recovery. It does not currently include Apple, Google, or Facebook sign-in.
- Email address and password-related authentication information.
- Six-digit email verification and password-recovery codes, together with their expiry and attempt controls.
- Account identifiers, session information, legal-acceptance version, and acceptance time.
- Information needed to protect accounts, prevent abuse, and respond to support requests.
4. Profile information
- Name, email address, phone number, and country-code information.
- Profile photograph, Instagram handle, biography, and privacy preferences.
- Vehicle make, model, year, nickname, drive count, and drive level.
- Profile completion and account status information.
5. Club and drive information
- Club names, descriptions, logos, cover images, social handles, location, visibility, joining rules, and club terms.
- Membership, role, experience level, vehicle information, join requests, invitations, approvals, bans, and participation status.
- Drive titles, descriptions, dates, meeting points, meeting coordinates, difficulty, drive type, participant limits, attendance, assigned roles, drive terms, approvals, cancellations, completion, and abortion status.
- Messages or notifications generated by club and drive activity.
6. Location and route information
When you grant permission, Bayaban may collect and process precise device location during an active drive, including in the background where your device and operating system allow it. This may include latitude, longitude, altitude, speed, heading, timestamps, horizontal and vertical accuracy, GPS quality, source, gaps, interruptions, route eligibility, live-session status, and route segments.
Bayaban may also process meeting-point coordinates, incident coordinates, emergency coordinates, resolved locations, and other location information you or an authorised drive role submits.
Location is used to record and display drives, support live-drive coordination, calculate route and elevation information, support safety features, and create drive reports. Precise location may be visible to people authorised through the relevant club, drive, role, or privacy settings.
7. Safety and incident information
If users use safety or incident features, Bayaban may process emergency activations, incident type and status, affected participants, notes, timestamps, role information, locations, resolution details, and related operational events. This information is used to coordinate the drive, communicate safety information, maintain records, and investigate misuse or incidents.
Bayaban is not an emergency service. Do not rely on the Service as your only method of obtaining emergency help.
8. Device, network, and technical information
- Device platform, operating-system information, app environment, app version, permission states, and push-notification token.
- Connectivity state, authentication and session events, synchronisation state, error messages, timestamps, and diagnostic information needed to operate and troubleshoot the Service.
- Information automatically handled by our service providers to secure, deliver, maintain, and monitor their services, such as network or request information.
9. Information stored on your device
Bayaban may store a local copy of account, profile, club, drive, participant, track, session, notification, preference, and synchronisation information in the app’s local storage so the app can open quickly, work with limited connectivity, and reconcile changes later.
Local copies may remain on a device until you sign out, switch accounts, uninstall the app, clear the app’s data, or the app removes them during account or cache management. Deleting server-side information does not by itself guarantee that every device copy has already been removed if the device is offline or inaccessible.
10. Information from other people
Other users may provide your name, membership, attendance, assigned role, vehicle information, participant status, or information connected with a club, drive, incident, or emergency. Club and drive organisers may also submit information about participants in accordance with their responsibilities and the Service permissions.
11. How we use information
- Create and secure accounts, authenticate users, verify email addresses, and recover passwords.
- Provide profile, club, drive, attendance, route, map, report, notification, and synchronisation features.
- Record active drives, display authorised live information, support route handover and marshal coordination, and provide safety and incident features.
- Apply privacy settings, club and drive permissions, approvals, invitations, role controls, and access restrictions.
- Send requested or relevant notifications, reminders, status updates, safety alerts, and service messages.
- Prevent fraud, abuse, unauthorised access, security incidents, and unlawful activity.
- Troubleshoot errors, maintain reliability, respond to support requests, enforce our Terms, and comply with legal obligations.
- Protect the rights, safety, and property of users, Bayaban, and other people.
12. Our current limits on use
Bayaban currently does not sell, rent, or use your personal information for advertising. We do not currently use your information for AI model training, unrelated analytics, or unrelated product-improvement activities. We also do not currently share it with a third party for those purposes.
This does not prevent processing that is necessary to operate the Service, such as hosting, authentication, storage, map display, email delivery, push notifications, security, or technical support.
If our practices materially change, we will update this policy and provide consent, an opt-out, or other choices where required by applicable law. An update will not by itself be treated as unlimited permission to use information for an unrelated purpose where the law requires a separate choice.
13. Permissions and choices
- Location permission is requested for active-drive recording and related features. Background location is requested only where needed for an active background recording feature.
- Notification permission is optional. You can control notification preferences in Bayaban and your device settings.
- Photo or media permission is used when you choose to add a profile or club image.
- You may change available permissions through your device settings. Some features may stop working or become less accurate if permission is withdrawn.
14. When we share information
We share information only as needed to provide the Service, follow your choices, protect people, or comply with law. Categories of recipients may include:
- Other users, club members, drive participants, organisers, and assigned roles who are authorised to see the relevant information through the Service.
- Supabase, which provides database, authentication, storage, hosting, and related backend services.
- Google Maps Platform, which provides map and location-visualisation services used by the app.
- Expo Push Service and relevant device-platform services for delivering push notifications.
- Email and OTP delivery providers used to send verification and recovery messages.
- Hosting, storage, security, infrastructure, support, and professional service providers acting on our instructions or providing services necessary to operate Bayaban.
- Authorities, advisers, insurers, or other recipients where disclosure is required by law, court order, legal process, or a genuine safety or security need.
- A successor, buyer, investor, or adviser if Bayaban or relevant assets are reorganised, transferred, or sold, subject to applicable confidentiality and legal requirements.
15. Clubs and other users
Information shown within a club or drive is shared according to the relevant settings, permissions, roles, invitations, and rules. A club organiser may receive information needed to run its club or drive. Bayaban does not control how an authorised recipient stores, copies, screenshots, or reuses information after viewing it.
Before joining or sharing, consider whether the information includes your home location, routine, vehicle, phone number, precise route, or other information you do not want others to know.
16. International processing
Because Bayaban is available worldwide and uses international service providers, information may be processed or stored outside Pakistan and outside the country where you live. Those locations may have different privacy laws. We use contractual, technical, organisational, or other safeguards appropriate to the service and applicable law, where required.
17. Retention
We keep information for as long as needed to provide and secure the Service, maintain records you request, resolve disputes, enforce our Terms, prevent abuse, meet legal obligations, and protect safety. Current operational records may remain while your account is active.
If you do not sign in for 365 consecutive days, your account is intended to be deleted under our inactive-account policy. Signing in restarts that period. This policy depends on the account-management process being active and may be affected by legal, security, or technical requirements.
Notifications and temporary operational records may have shorter lifetimes where the Service applies an expiry period. Backups and system logs may remain for as long as the relevant systems retain them and may be kept for security, reliability, audit, fraud prevention, or legal purposes. They are not used as an ordinary user account after deletion.
18. Account deletion
You may start account deletion from the account controls in the app. Account deletion is permanent and cannot be undone. After a deletion request is confirmed, we will delete account-associated information from active Bayaban production systems and storage without undue delay, subject to information that must be retained by law, security controls, provider systems, or technical backup cycles.
We do not need to retain your club history or drive history for other users after your account is deleted. Information that cannot be immediately removed from a backup or security log will be isolated from ordinary use and removed or overwritten according to the applicable system’s retention process.
Deletion may remove access to your profile, clubs, drives, reports, routes, notifications, and other account-linked information. You should export or save anything you are entitled to keep before requesting deletion.
19. Your rights
Depending on where you live and which laws apply, you may have rights to request access to, correction of, deletion of, restriction of, or a copy of your personal information; object to certain processing; withdraw consent where processing is based on consent; and complain to a relevant privacy regulator.
To make a request, email bayabanapp@gmail.com from the email address associated with your account and explain what you are requesting. We may need to verify your identity. We will respond within the time required by applicable law and may explain if a lawful exception applies.
Withdrawing permission or consent does not affect processing that already occurred lawfully or processing needed to provide a feature you continue to use. You may also have the right to appeal a refusal where applicable law provides one.
20. Security
We use reasonable technical and organisational measures intended to protect information, including access controls, authentication protections, encrypted connections where supported, permissions, and account-deletion controls. No service, device, network, or storage system can be guaranteed completely secure.
You are responsible for your password, device security, permissions, and what you choose to share. If you believe information or an account has been compromised, contact bayabanapp@gmail.com promptly.
21. Children
Bayaban is for people aged 18 and over. We do not knowingly invite or intentionally collect information from anyone under 18. If you believe a minor has created an account or provided information, contact us so we can investigate and take appropriate action.
22. Automated decisions
Bayaban does not currently make decisions about users based solely on automated processing that produce legal or similarly significant effects. The Service may use rules and permissions to display content, control access, manage attendance, send reminders, or protect security.
23. Changes to this policy
We may update this Privacy Policy as the Service, law, or data practices change. The latest version will be posted on this page with its effective date. If a change is material, we will provide additional notice or request consent where required by law.
If you continue using the Service after an updated policy takes effect, the updated policy will apply to future processing, subject to any consent or other legal requirement.
24. Contact and deletion requests
For privacy questions, rights requests, security concerns, or account-deletion support, contact bayabanapp@gmail.com. Please use the email address associated with your Bayaban account when requesting account-specific action.
Account deletion
You can start permanent account deletion from the account controls inside the Bayaban app. If you cannot access the app, email bayabanapp@gmail.com from your registered email address and request deletion.
Deletion is permanent. We will remove account-associated information from active Bayaban systems without undue delay, subject to the limited backup, security, legal, and technical exceptions described in the Privacy Policy.
